IR senior officer awarded ‘removal from service’ for corruption

ISLAMABAD: Federal Board of Revenue (FBR) on Wednesday imposed major penalty upon Muhammad Mustafa Kamal, BS-19 officer of Inland Revenue Service, presently posted as Additional Commissioner-IR, Regional Tax Office III, Karachi on the charges of inefficiency, misconduct and corruption.
The FBR said disciplinary proceedings were initiated against Muhammad Mustafa Kamal vide order of inquiry dated April 07, 2009.
Ms. Lubna Farrukh Mirza the then Chief Commissioner-IR, Regional Tax Office-II, Karachi as Chairperson of the Inquiry Committee and Syed Ayaz Mahmood the then Chief Commissioner-IR, Regional Tax Office, Hyderabad as Member of Inquiry Committee.
The inquiry committee submitted inquiry report on June 08, 2015 with the findings that the accused officer is found guilty of inefficiency misconduct and corruption.
On the basis of inquiry report, a show cause notice was issued on June 24, 2015 to the accused officer with the directions to show cause within seven (07) days of the receipt of the notice as to why penalty, including Major Penalty of Dismissal from service should not be imposed upon him.
The accused officer failed to furnish reply to the show cause notice.
An opportunity of personal hearing was granted to accused officer on October 15, 2015. However he failed to appear for personal hearing.
Final show cause notice was published in news paper on October 22, 2015 with the directions to show cause within seven (07) days of publication of this notice as to why penalty, including major penalty of dismissal from service should not be imposed upon him but no response was again received from the accused officer.
He was further granted opportunities of personal hearings on March 29, 2016, October 20, 2016, March 03, 2017 and July 11, 2017. However, the officer failed to avail the opportunities.
After examining the record of the case and findings of the inquiry committee, the Competent Authority, i.e Secretary Revenue Division after having considered all aspects and material relating to the case and findings of the inquiry committee has decided to impose Major Penalty of Removal from service.
Muhammad Mustafa Kamal (IRS/BS-19) Additional Commissioner-IR, Regional Tax Office-III, Karachi, however, shall have the right to appeal to the Appellate Authority under Civil Servants (Appeals) Rules, 1977 as provided under the relevant Rules.
