Tax officials barred from recovery where 10pc paid of total payable

KARACHI: Federal Board of Revenue (FBR) has directed the tax offices to avoid initiating recovery where taxpayers paid 10 percent of total payable tax and cases are before the commissioner appeal.
The FBR in explaining the changes in sales tax laws brought through Finance Act, 2018, said that condition of payment of 25 percent of the amount of tax involved to qualify for automatic stay against recovery till disposal of appeal by the commissioner (Appeals) has been reduced to 10 percent through amendment made in Section 48 of the Sales Tax Act, 1990.
The FBR directed the field formations to adhere to the provision and do not initiate recovery proceedings till disposal of appeal by the Commissioner (Appeals) in those cases where 10 percent of the amount of tax involved has been paid.
